TERMS OF SERVICE

1. About Us
This website and online store are operated by MHF Vending Pty Ltd, trading through brands including MHF Studio ("MHF Vending", "MHF Studio", "we", "us" or "our").
We provide products and services including personalised phone cases, custom-printed products, branded merchandise, event activations and related products and services.
Our online store is powered by Shopify.
By accessing our website, placing an order or using our services, you agree to these Terms of Service and any policies referred to in them, including our Privacy Policy and Refund Policy.
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law (ACL) or any other law that cannot lawfully be excluded.
2. Eligibility and Customer Information
You must provide accurate and complete information when placing an order, including your name, email address, delivery address and payment information.
You are responsible for ensuring that the information supplied is correct before submitting your order.
If incorrect information supplied by you results in an order being delivered incorrectly, delayed, returned or requiring reproduction, additional charges may apply where permitted by law.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials.
3. Products and Product Images
We take reasonable steps to accurately represent our products.
However, colours, brightness and appearance may vary between screens and devices. Printed colours may also differ slightly from how an image appears digitally.
For personalised products, minor variations may occur in:
- colour reproduction;
- image positioning;
- cropping;
- scaling;
- alignment; and
- the positioning of artwork around cameras, edges, buttons and other physical features of a device.
These variations are inherent in personalised printing and manufacturing and do not necessarily constitute a defect.
Nothing in this section limits your rights under the Australian Consumer Law.
4. Personalised and Custom Products
Many MHF Studio products are made specifically for an individual customer using photographs, images, artwork, text or other content supplied or selected by that customer.
Before submitting an order, you are responsible for checking:
- the selected phone/device model;
- case type;
- photographs and artwork;
- spelling and text;
- image orientation;
- cropping and positioning; and
- other customisation choices.
Where our website provides a preview, mock-up or design tool, it is intended as a reasonable representation of the finished product and may not reproduce the finished item with absolute precision.
Image quality
The quality of the finished product depends partly on the quality of the image supplied.
Low-resolution, blurred, compressed, dark or otherwise poor-quality source images may produce corresponding results when printed.
Where reasonably practicable, we may identify an obvious image-quality problem before production, but we are not required to manually inspect every image supplied.
Production
Because personalised products are manufactured specifically for you, production may commence shortly after an order is accepted.
Once production has commenced, we may be unable to change or cancel the order.
This does not affect any rights you have under the Australian Consumer Law.
5. Customer-Submitted Content
When you upload or provide a photograph, logo, illustration, artwork, design, text or other content ("Customer Content"), you confirm that:
- you own the Customer Content or have permission to use it;
- you have the necessary rights and permissions for us to reproduce it for your order;
- our use of it to fulfil your order will not infringe another person's copyright, trademark, privacy or other legal rights; and
- the content does not breach applicable law.
You retain ownership of your Customer Content.
You grant MHF Vending a limited, non-exclusive licence to reproduce, modify as technically necessary, print and otherwise process the Customer Content solely to provide your requested product or service, fulfil your order, provide customer support and meet our legal obligations.
We do not obtain ownership of your photographs merely because you upload them to our service.
6. Content We May Refuse to Print
We reserve the right to refuse or cancel an order containing content that we reasonably believe:
- is unlawful;
- infringes intellectual property rights;
- infringes another person's privacy or other rights;
- contains unlawful sexually explicit material;
- promotes serious unlawful activity;
- contains unlawful hate material; or
- cannot lawfully be produced or supplied by us.
Where we cancel an order before production for one of these reasons, we will ordinarily refund amounts paid for the product unless applicable law permits otherwise.
7. Orders
Submitting an order constitutes an offer to purchase the selected products or services.
An order is accepted when we confirm acceptance or commence fulfilling the order.
We reserve the right to reject or cancel an order where reasonably necessary, including because of:
- product unavailability;
- an obvious pricing or listing error;
- suspected fraud;
- payment failure;
- inability to fulfil the requested customisation; or
- Customer Content that breaches these Terms.
If we cancel an order after payment and you are entitled to a refund, we will refund the applicable amount using the original payment method where reasonably possible.
8. Pricing and Payment
Prices are displayed in Australian dollars (AUD) unless otherwise stated.
Where applicable, prices include GST unless clearly indicated otherwise.
Shipping or other applicable charges will be displayed during checkout before you complete your purchase.
Prices and promotions may change from time to time. The price applicable to your purchase is generally the price displayed when your order is submitted, subject to correction of obvious errors and applicable law.
You must be authorised to use the payment method supplied.
9. Shipping and Delivery
Delivery timeframes displayed by us are estimates unless expressly stated otherwise.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, severe weather, incorrect delivery information and other disruptions.
We will take reasonable steps to fulfil and dispatch orders within the indicated timeframe.
If an order is lost, damaged or materially delayed, contact us at admin@mhfvending.com.au so that we can investigate.
Nothing in this section limits any rights or remedies available under the Australian Consumer Law.
10. Returns, Refunds and Personalised Products
Because personalised products are made specifically to a customer's specifications, we do not ordinarily accept returns, exchanges or cancellations solely because you change your mind after production has commenced.
This includes situations where:
- you selected the wrong phone model;
- you supplied the wrong image;
- you made a spelling error;
- you changed your mind about the image or design; or
- you no longer want the product,
provided that we supplied the product in accordance with your order and our legal obligations.
However, this policy does not limit your rights under the Australian Consumer Law.
If a product is faulty, damaged, materially different from what you ordered, or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.
ACCC guidance confirms that businesses generally don't have to provide a refund simply for change of mind, but cannot use a "no refunds" policy to remove statutory remedies for faulty products.
Our separate Refund Policy forms part of these Terms.
11. Australian Consumer Law
Our products and services come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms is intended to exclude, restrict or modify those guarantees or any other statutory right or remedy that cannot legally be excluded, restricted or modified.
Depending on the circumstances and whether a failure is major or minor, remedies available under the Australian Consumer Law may include repair, replacement, refund, rectification or compensation for reasonably foreseeable loss or damage.
12. MHF Studio Events and Activations
Where MHF Studio provides live printing, personalised products or other services at an event, activation, corporate function or similar engagement, additional terms contained in the applicable proposal, quotation or agreement may apply.
Where there is an inconsistency between these website Terms and a separately agreed written event proposal or agreement, the specifically agreed terms will apply to that engagement to the extent of the inconsistency, subject to applicable law.
Event organisers are responsible for providing any venue access, permissions, facilities, power, space or other requirements expressly agreed as their responsibility.
Production capacity at live activations may depend on event duration, customer demand, available device models and printing time.
Where an item cannot reasonably be completed during an event, we may offer post-event fulfilment where this forms part of the agreed activation arrangements.
13. Intellectual Property
Unless otherwise stated, the website, MHF Vending and MHF Studio branding, logos, graphics, designs, text, photographs and other content created or owned by us are owned by or licensed to MHF Vending and are protected by applicable intellectual property laws.
You may use our website for personal and lawful purposes.
You must not reproduce, distribute, commercially exploit or substantially copy our proprietary content without our permission except where permitted by law.
This section does not transfer ownership to us of Customer Content uploaded in accordance with Section 5.
Shopify and other third-party names, logos and trademarks remain the property of their respective owners.
14. Third-Party Services
Our website may use or integrate services provided by third parties, including payment processors, shipping providers, ecommerce platforms, analytics providers and marketing platforms.
Some third-party services may have their own terms and privacy policies.
We are not responsible for independent third-party websites or services except to the extent responsibility cannot lawfully be excluded.
15. Shopify
Our online store is powered by Shopify.
Shopify provides technology that enables us to operate the online store, but purchases made through our store are transactions between you and MHF Vending, not Shopify.
Your use of Shopify functionality may also involve processing of information by Shopify in accordance with its applicable privacy terms.
16. Privacy
We handle personal information in accordance with our Privacy Policy and applicable Australian privacy law.
Information required to process an order may be provided to service providers where reasonably necessary to operate our store, process payments, manufacture or fulfil products, deliver orders, provide customer support, operate marketing services or otherwise provide our services.
Some technology and service providers may process information outside Australia.
Where the Australian Privacy Principles apply to us, we will handle relevant overseas disclosures in accordance with applicable requirements.
The OAIC notes that APP entities can have additional obligations where personal information is disclosed to overseas recipients, including reasonable steps regarding the recipient's handling of the information.

17. Feedback and Reviews
If you voluntarily provide a review, testimonial, suggestion or other feedback, you grant us a non-exclusive, worldwide, royalty-free licence to use and reproduce that feedback for legitimate business and promotional purposes.
This does not automatically give us permission to use a customer's private photographs or personalised case artwork in advertising.
If we wish to use identifiable Customer Content for promotional purposes beyond what is reasonably covered by the customer's consent, we will seek appropriate permission.
You must not submit a review or other material that infringes another person's rights or is unlawful or deliberately misleading.
18. Prohibited Uses
You must not use our website or services:
- for an unlawful purpose;
- to infringe another person's intellectual property or privacy rights;
- to submit fraudulent information;
- to distribute malware or malicious code;
- to interfere with the operation or security of our website;
- to impersonate another person;
- to conduct unauthorised scraping or automated extraction; or
- to attempt to circumvent security or access controls.
We may restrict access where reasonably necessary to protect our customers, systems or legal rights.
19. Errors and Availability
Occasionally our website may contain typographical errors, incorrect product information, availability errors or pricing errors.
We may correct genuine errors and update information.
If an error materially affects an order already placed, we will contact you where appropriate and deal with the order in accordance with applicable law.
20. Disclaimer and Limitation of Liability
To the maximum extent permitted by law, we exclude warranties, representations and liabilities that may lawfully be excluded.
However, nothing in these Terms excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot be excluded, restricted or modified under the Australian Consumer Law or other applicable law.
Where our liability can lawfully be limited, it will be limited only to the extent permitted by law.
We are not responsible for losses caused by matters outside our reasonable control except where applicable law provides otherwise.
21. Indemnity
To the extent permitted by law, you are responsible for loss reasonably suffered by us as a direct result of your unlawful use of our services or your material breach of these Terms, including where Customer Content supplied by you infringes a third party's rights.
This section does not require you to indemnify us for loss caused by our own negligence, unlawful conduct or breach of these Terms, and does not limit any rights you have under applicable law.
22. Suspension and Termination
We may suspend or terminate access to our services where reasonably necessary because of fraud, unlawful activity, material breach of these Terms, misuse of our systems or threats to the security of our services.
Termination does not affect rights or obligations that accrued before termination.
23. Governing Law
These Terms are governed by the laws applicable in New South Wales, Australia.
You and MHF Vending submit to the jurisdiction of the courts of New South Wales and courts entitled to hear appeals from them.
Nothing in this section prevents a consumer from exercising any right they have under applicable consumer legislation or other law that cannot lawfully be excluded.
24. Changes to These Terms
We may update these Terms from time to time.
The current version will be published on our website with the applicable "Last updated" date.
Changes will not retrospectively remove rights that have already accrued under an existing transaction.
